§ 6-30. Same—Vicious, diseased dogs.

  • (a)

    It shall be unlawful for any person owning a dog to permit it to run or remain at large and unrestrained within the city limits when:

    (1)

    Such person knows or reasonably should have known that the dog is dangerous or vicious, or has in the past shown a propensity to be dangerous or vicious, or when such person knows that the dog has at any time in the past attacked, mauled, molested, bitten or menaced any person without apparent provocation; or

    (2)

    Such person knows or reasonably should have known that the dog is afflicted with a contagious or infectious disease that can deleteriously affect the health of persons or other domestic animals.

    (b)

    If the owner of any diseased or infected dog found at large and unrestrained within the city limits shall have failed to obtain for such dog any vaccination or treatment required by other provisions of this article, he shall be presumed to have known of the diseased or infected condition of the dog.
