§ 8-268. Contesting lien foreclosure.

  • Any person owning or claiming any interest in property repaired or removed pursuant to a resolution of the council, against which a lien is so placed, who shall desire to contest such lien on account of the amount thereof, or the necessity of having such work done, or any inaccuracy, irregularity, invalidity or insufficiency of the proceedings or contract with reference thereto, or on account of any manner or thing not in the discretion of the council, shall have the right to appeal therefrom by instituting suit for that purpose in any court having jurisdiction within ten days from the time such lien is fixed. Any person who shall fail to institute such tax suit within such time shall be held to have waived every matter which might have been taken advantage of, and shall be barred or estopped from contesting or questioning the necessity of having such work done, and the amount of the claim therefor.
