§ 24-269. Definitions.

The following words, terms and phrases, when used in this article, shall have the meanings ascribed to them in this section, except where the context clearly indicates a different meaning:

Designated, established business location within the city means the ownership and occupancy of a lot or other tract of land, and building thereon within the city used by the person, or the person, partnership, firm, association, corporation or other form of business entity he represents, such building being used in the direct selling of the product or service within the city, provided that leasing or renting of such building is for a continuous period of time, or not less than 90 days.

Designated, established residence within the city means the ownership and legal and continuous occupancy of a lot or other tract of land and residence located thereon within the city by such person, or by the person he represents or the prior continuous occupancy, for a period of not less than 90 days, or rented or leased quarters within the city, by such person, or the person he represents, as the only residence or place abode of either such person.

Itinerant or transient vendor means any person representing himself or representing another person, partnership, firm, association, corporation or other form of business entity, selling any product or service within the city, when neither such person or the person, partnership, firm, association, corporation or other business entity he represents has a designated, established residence or business location within the city.

Product or service means any physical or material object or item, or any service of whatsoever nature, or any property right of any value represented by oral or written promise or contract.

Selling means selling, leasing or renting direct to the ultimate owner or user of such product or service, or to the agent or other representative of the ultimate owner or user of such product or service, whether such selling involves the delivery of the product or service at the time of the sale, or the taking of orders for future delivery, and whether such selling involves payment in advance, payment on delivery, by whatever means of delivery or deferred payment after the delivery of the product or service sold.

Ultimate owner or user means any member of any family for any other member of such family.
